1. About Aalababa India

Aalababa.in (“Aalababa”, “we”, “us”, or “our”) is an online marketplace platform operated in India.

The platform enables users to post, browse, and promote advertisements for goods and services including cars, property, and general items.

Aalababa acts solely as an intermediary under the Information Technology Act, 2000, and does not participate in transactions between buyers and sellers.

2. Acceptance of Terms

By accessing or using Aalababa.in, creating an account, posting advertisements, or purchasing paid services, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you must not use the platform.

3. Eligibility

To use Aalababa.in, you must:

Be at least 18 years of age
Be legally capable of entering into binding contracts
Provide accurate, complete, and truthful information

Business users confirm they are authorised to act on behalf of their entity.

4. User Accounts

Users are responsible for maintaining account confidentiality
All activities conducted through an account are the user’s responsibility
Aalababa may suspend or terminate accounts that violate these Terms

5. Listings & User Content

5.1 Free Listings

Basic listings may be posted free of charge
Listings are time-limited and subject to platform rules
Aalababa may limit photos, duration, or visibility

5.2 User Responsibility

You confirm that:

Listings are accurate, lawful, and not misleading
You have the legal right to sell or advertise the item
Content does not violate any law, regulation, or third-party rights

Aalababa does not verify ownership, authenticity, or condition of items.

6. Prohibited Content & Activities

Users must not:

Post illegal, prohibited, or restricted goods
Engage in fraud, scams, or misrepresentation
Post duplicate, spam, or misleading advertisements
Circumvent platform fees or systems
Harass or abuse other users
Violate intellectual property rights

Aalababa reserves the right to remove content or accounts without notice.

7. Paid Services

7.1 Paid Promotions

Aalababa offers optional paid services including:

Boosted listings
Featured placements
Urgent or promotional badges
Dealer or business plans

Paid services do not guarantee sales, leads, or enquiries.

7.2 Payments

Payments are processed via secure third-party gateways, including UPI
Applicable GST may be charged as per Indian law
You authorise Aalababa to charge your selected payment method

7.3 Refund Policy

Paid promotional services are non-refundable once activated
If a service fails due to a technical error, a replacement or refund may be offered at our discretion
No refunds for dissatisfaction, lack of response, or user error

8. Dealers & Business Users

Business accounts may be subject to fair usage limits
Promotional or discounted plans may be time-bound
Aalababa may revise pricing or plans with reasonable notice

9. Transactions Between Users

Aalababa does not handle delivery, inspection, payment, or title transfer
Buyers and sellers transact at their own risk
Users are responsible for due diligence before completing transactions

10. Verification & Trust Measures

Optional verification features may be offered
Verification does not guarantee legitimacy or trustworthiness
Users remain responsible for independent verification

11. Intermediary Safe Harbour

Aalababa is an intermediary under Section 79 of the Information Technology Act, 2000.

We are not liable for user-generated content provided we comply with applicable legal obligations.

12. Content Moderation

Aalababa reserves the right to:

Remove or disable access to listings
Suspend or terminate accounts
Limit advertisement visibility

Actions may be taken to comply with law, protect users, or enforce these Terms.

13. Intellectual Property

Aalababa owns all platform software, branding, and design
Users retain ownership of their content but grant Aalababa a licence to display it
Platform content may not be copied or reused without permission

14. Privacy & Data Protection

User data is handled in accordance with the Indian IT Act & Rules and Aalababa’s Privacy Policy.

15. Disclaimer of Warranties

Aalababa is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted service or transaction outcomes.

16. Limitation of Liability

To the maximum extent permitted by law, Aalababa shall not be liable for:

Loss of profits, data, or business
Fraud or misconduct by users
Indirect or consequential damages

Total liability shall not exceed the amount paid by the user to Aalababa in the previous 12 months.

17. Indemnity

You agree to indemnify Aalababa against claims arising from your listings, use of the platform, or breach of these Terms or applicable law.

18. Termination

Users may close accounts at any time
Aalababa may suspend or terminate accounts for violations or legal requirements

19. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in India shall have exclusive jurisdiction.
